Recall Roundup: Cucumbers, Tires, Cars, Lawn Mowers and More

Here is this week's roundup:

  • L&M Cos. Inc. recalled about 1,590 cartons of whole cucumbers sold under the Nature's Delight brand because they could be contaminated with salmonella, said the U.S. Food and Drug Administration. Salmonella can cause a potentially life-threatening infection in the very young, frail or elderly as well as diarrhea, nausea and other symptoms in normally healthy people. The cartons were sent to wholesalers in Florida, Illinois, Indiana, New York and Tennessee, and one retailer with distribution centers in Mississippi, Nebraska, Texas and Wyoming. The company said the cucumbers may have been redistributed to other states as well. The cartons have the lot number PL-RID-002990 on them.   • Continental Tire recalled nearly 391,000 tires -- most of which were sold on new 2008 and 2009 Ford F-250 and F-350 trucks -- because the tires may wear unevenly, which could lead to a separation of the belt edges, increasing the risk of a crash, said the National Highway Traffic Safety Administration. The agency lists the tire numbers affected by the recall on its site. Continental will notify owners and replace the tires. Consumers can call the company at (888) 799-2168.
  • The Toro Co. recalled about 23,000 snowblowers and 6,200 lawn mowers in the United States and Canada because the carburetors on both develop fuel leaks and can ignite when exposed to an ignition source, the U.S. Consumer Product Safety Commission said. The company has received about 500 reports of leaks, but there were no reports of fires or injuries. The CPSC lists the serial numbers included in the recall. Consumers should contact a Toro Service Dealer for a repair. Call the company at (877) 738-4440 weekdays from 9 a.m. to 5:30 p.m. EST.
  • Amid a new round of recalls of medical disinfecting wipes, an FDA inspection report of a pair of businesses at the center of the recalls detailed manufacturing violations that prompted the agency to seize more than $6 million in medical products at its Hartland, Wis., facilities.
  • Jonathans Sprouts expanded its recall of alfalfa sprout products to include all its alfalfa products because they may be contaminated with salmonella, the FDA said. The FDA lists the products included in the recall. The products containing alfalfa sprouts were distributed in Connecticut, Deleware, Maine, Maryland, Massachusetts, New Hampshire, New Jersey, New York, Pennsylvania, Rhode Island and Vermont. The sprout products were sold in the following stores: A&P, Grand Union, Stop & Shop, Shaws, Hannaford, Donnelans, Foodmaster, Truccis and Roche Brothers. Consumers can return the products for a refund. Call the company at (508) 763-2577.
  • Nissan North America Inc. recalled almost 196,000 Nissan Pathfinders and Infiniti QX4s because road salt used in 20 northern states and Washington, D.C., during the winter can corrode part of the sport utility vehicle's strut housing.
  • Toyota recalled about 51,000 of its 2011 model year Tundra trucks because part of the rear drive shaft can break.
  • Heartland America recalled 5,850 wooden stools because the legs and seats can crack and break, spilling a consumer onto the floor, the CPSC said. The company has received 11 reports of the stools breaking, including seven reports of injuries (one person suffered a cut to the head). The stools were sold through the Heartland America catalog and website from June 2010 through February 2011 for about $30 each. Consumers should return the stools for a refund. Call the company at (800) 398-8163 weekdays between 9 a.m. and 6 p.m. EST.
  • Simple Foods recalled its Carob Brown Rice Crunch Squares and its Carob Mint Miniatures because they contain milk that isn't listed on the packaging, the FDA said. The recalled crunch squares are packaged in an uncoded 1.6 ounce cellophane package with a UPC code of 36664-00300. The recalled mint miniatures are in an uncoded 5.5 ounce cardboard box. Both products were sold at various health food stores in New Hampshire, New Jersey, New York and Pennsylvania. Consumers can call the company at (716) 743-8850.
  • Elsie Grace's Dry Food Co. recalled certain dip mix and soup mix products because they may contain milk, soy or wheat not listed on the packaging, the FDA said. The mixes were sold in gift shops and groceries in Arkansas, Illinois, Indiana, Iowa, Kansas, Kentucky, Michigan, Missouri, Nebraska, North Carolina, Ohio, Oklahoma, Pennsylvania, South Dakota and West Virginia. The FDA lists the products affected by the recall; consumers can return them for a refund. Call the company at (785) 292-4438 weekdays between 10 a.m. and 6 p.m. EST.
  • The Raymond-Hadley Corp. recalled certain varieties of Better Batter brand baking mixes because they could contain milk that isn't listed on the label, the FDA said. The mixes were distributed throughout the United States and Canada in stores, by mail order and direct delivery. The FDA lists the products affected by the recall; consumers can return the products for a refund. Call the company at (800) 252-2220 weekdays between 8 a.m. and 4:30 p.m. EST.
  • American Regent recalled its Ammonium Molybdate Injection, USP (Molybdenum 250mcg/10mL) 10mL Single Dose Vial NDC 0517-6610-25, with a lot number 9409 and an expiration date of June 2011 because some vials had particulates in them, the FDA said. The injections are used as supplements for those fed intravenously. The vials were distributed to wholesalers and distributors nationwide. Consumers can call the company at (877) 778-3232 weekdays between 8:30 a.m. and 7 p.m. EST.
  • Ducduc recalled 330 fixed-side cribs because the bottom rails can separate from the sides, creating a risk that children could be trapped or fall, the CPSC said. While the company has received five reports of the rails separating, no one has been hurt. The CPSC lists the item codes of those cribs affected by the recall. The cribs were sold in New York, online and in specialty stores and through interior designers nationwide from January 2009 through February 2011 for between $1,500 and $1,800. Consumers should call the company for a repair kit at (212) 226-1868 between 9 a.m. and 5 p.m. EST.
  • Tri City Cheese and Meats Inc. recalled 87 pounds of teriyaki flavor kippered turkey and beef products because they contain both wheat and soy that weren't listed on the label, said the U.S. Department of Agriculture's Food Safety and Inspection Service. The USDA lists the product names and sell-by dates affected by the recall on its site. Consumers can call the company at (989) 686-3210.

Year after spill, Gulf Coast hopes for busy Memorial Day

(CNN) -- Workers involved in the tourism industry along the U.S. Gulf Coast hope this Memorial Day weekend is one of their best in a long time. The threat of oil from the Deepwater Horizon spill kept many tourists away from beach communities last year.

Since the oil spill, BP has provided money to states to help promote tourism.

So far, the oil giant says it has given Florida $42 million, Mississippi $18 million, Alabama nearly $30 and Louisiana $25 million in tourism grants.

Here are some comments about Gulf Coast tourism from people who work in the sector:

Mississippi

Janice Jones, a marketing manager at the Mississippi Gulf Coast Visitors Bureau said she is "hopeful about this year." She said "everyone kind of looks around for the piece of wood to knock on when you say that."

In addition to the 2010 oil spill, the area was also devastated by Hurricane Katrina in 2005.

Jones said for Memorial Day weekend she is conservatively estimating that about 75% of hotel rooms will be booked -- a number that would be 10% more than in 2010 and the highest level in at least three years.

Additionally, she said the hotels this year will be filled with tourists, while last year they were filled largely with BP cleanup workers, who generally didn't spend money on tourist activities.

Alabama

Herb Malone, president and chief executive of Gulf Shores & Orange Beach Tourism said lodging rates have been climbing. "Since October 2010, we have seen an upward trend every month."

Memorial Day tourism numbers for beach areas are up, even compared to years before the spill.

Malone added, "We are seeing increases over 2009 figures, which is a good indication that things are moving in the right direction."

Florida

Will Seccombe, chief marketing officer for Visit Florida said "we are looking for a really solid Memorial Day, and a really solid summer."

Most of Florida's beaches never saw any crude come ashore.

The area impacted last year by the oil, or rumors of oil, is "clearly bouncing back and it's a big bounce" he said. "Northwest Florida is going to have an incredible rebound year."

Louisiana

"We are looking much better for recreational tourism this year," said Jacques Berry, spokesman for the state Department of Culture, Recreation and Tourism.

He said a study shows "we are rebounding well on a regional basis (but) we still have work to do nationally with the perception about Louisiana seafood."

Much of the state's tourism centers around eating and catching seafood.

"Locals (in the region) are quicker to understand what is going on," said Jill Kidder, co-executive director of the Louisiana Travel Promotion Association. "We are open and ready for business."

Friday, the Louisiana Department of Wildlife and Fisheries opened a six-mile stretch of beach known as Elmer's Island for the first time since it was hit by the oil.

It comes at a good time, Berry said. "Red snapper season opens this weekend and that is exactly where they all go."

Fed Focusing on Inflation Expectations with Policy Unchanged

May 23 (Bloomberg) -- The cue for the Federal Reserve to start withdrawing its record monetary stimulus may be a measure of its own credibility: inflation expectations.

Expectations for annual consumer-price gains have jumped by 43 percent to 2.10 percentage points since the central bank began its second round of asset purchases in November, as measured by the breakeven rate for five-year Treasury Inflation Protected Securities. The measure is close to levels before the recession -- when the central bank?s benchmark interest rate was 5.25 percent, compared with about zero today.

?It?s highly likely that some movement in inflation expectations will be the first signal that they need to take action,? said J. Alfred Broaddus, 71, former president of the Federal Reserve Bank of Richmond, whose career dates back to the inflation surge of the 1970s. ?The Fed is right to be watching this very, very closely.?

Central bankers are starting to debate how and when to tighten policy after buying $2.3 trillion of assets to bring the economy out of the recession. William C. Dudley, president of the Federal Reserve Bank of New York, says the Fed still has a ?considerable way to go? to reduce unemployment from 9 percent, while other policy makers, including the Philadelphia Fed?s Charles Plosser and Richard Fisher of Dallas, say waiting too long to tighten risks igniting inflation.

?This is one of those really critical turning points in monetary policy where it?s pretty clear the next move is toward tightness, and the whole question is timing,? Broaddus said.

Buying TIPS

Sean Simko, who oversees $8 billion in fixed-income assets at SEI Investments Co. in Oaks, Pennsylvania, said he?s buying Treasury Inflation Protected Securities because higher commodity prices are stoking inflation. Five-year breakeven rates reached 2.47 percentage points on April 29, their highest level in almost three years.

?The TIPS market represents a fair assessment of inflationary pressures,? Simko said. Breakeven rates are the yield difference between TIPS and comparable maturity Treasuries and are a measure of the outlook for consumer prices over the life of the securities.

Dudley, in a May 19 speech in New Paltz, New York, said the central bank is falling short of its goals because unemployment is too high and inflation is likely to ease. While measures of the public?s view of inflation ?remain stable,? Dudley said, ?it is critical that we ensure that inflation expectations do not become unmoored.?

Bernanke Press Conference

Chairman Ben S. Bernanke, in his first press conference April 27, indicated that the central bank won?t remove stimulus immediately after ending $600 billion in bond purchases in June. At the same time, he highlighted inflation expectations as a reason the Fed might tighten credit.

?If inflation persists or if inflation expectations begin to move, then there?s no substitute for action,? Bernanke, 57, said following a meeting of the Federal Open Market Committee. ?We would have to respond.?

Policy makers watch expectations because they can fuel actual inflation. Businesses may raise prices in anticipation of higher production costs, while consumers can demand higher wages to keep up with the price of goods. Unless restrained by central banks, the two processes together can accelerate inflation.

?It is much harder to keep inflation in check if people begin to raise their expectations of inflation,? Dudley said in his May 19 speech.

Inflation is a ?mindset,? and consumers build their expectations into their behavior, said Ward McCarthy, chief financial economist at Jefferies & Co. in New York. While breakeven rates are within the Fed?s target range, ?they?re right on the frontier. There?s not a lot of breathing room.?

?Important Force?

Inflation expectations, especially long-run projections, ?are an important force in inflation dynamics,? according to a 2008 research paper from the Federal Reserve Bank of Kansas City by Todd E. Clark, who?s now a vice president at the Cleveland Fed, and Troy Davig, now a senior economist at Barclays Capital in New York. ?Even small movements in long-run expectations can represent a persistent source of pressure on inflation,? they wrote.

The authors cite as evidence several studies showing a link. The Fed?s own computer model of the U.S. economy uses long-run expectations, as measured by surveys of professional economists, as a ?key determinant of inflation behavior,? Clark and Davig said.

The central bank aims for an inflation rate of about 1.7 percent to 2 percent, based on last month?s long-run economic projections of Fed governors and regional presidents.

Jeans, Hamburgers

Prices in March rose 1.8 percent from a year earlier, accelerating for a fourth straight month to the fastest pace since May 2010, as companies from San Francisco-based jeans supplier Levi Strauss & Co. to Oak Brook, Illinois-based fast- food chain McDonald?s Corp. announced price increases to make up for rising prices of cotton, wheat and other raw materials.

Excluding food and fuel, prices rose 0.9 percent in March from a year earlier, near a five-decade low of 0.7 percent. Fed officials prefer the so-called ?core? measure because food and fuel costs are more volatile.

Inflation, including all items, has averaged 2.1 percent a year over the past 10 years, and the same rate over the prior decade. It was 4.8 percent during the 1980s and 6.7 percent in the 70s, based on the Commerce Department?s personal consumption expenditures price index.

St. Louis Fed President James Bullard said May 18 that central bankers are ?determined? to avoid a repeat of the 1970s inflation. Paul Volcker, who took over as chairman in 1979, kept the federal funds rate on overnight loans among banks above 8 percent for more than five years, pushing it as high as 20 percent.

Forecasters Erred

During that decade, ?forecasters consistently underpredicted the future level of inflation, seeing considerably more disinflation from a particular policy stance than in fact occurred,? former Fed Vice Chairman Donald Kohn said in a 2007 speech. Fed staff economists and bond investors both made such mistakes, Kohn said.

?I lived through that whole thing, and it was awful,? said Broaddus, who joined the Richmond Fed in 1970 and ran it from 1993 to 2004. Even though there hasn?t been an incident of similar magnitude since then, policy makers ?know that can happen,? he said. It?s ?always out there as the lesson of what can happen if the Fed begins to lose focus on its main job of focusing on price stability.?

Now Fed officials often speak of the credibility they regained from Volcker?s inflation victory and how careful they must be not to let it slip away.

Business Cycle

?This is the point in the business cycle when the risk of losing a bit of credibility and risk of losing ground on inflation is highest,? Jeffrey Lacker, the current president of the Richmond Fed, told reporters May 10.

The market-based measure of inflation five to 10 years out ?is a proxy on their credibility completely,? Davig said. ?Any kind of financial market movement that would indicate the market?s lack of belief in the Fed?s ability to execute a smooth exit strategy -- the Fed?s completely fearful of that.?

The five-year breakeven measure has dropped 0.37 percentage points since the end of April, even as the total Consumer Price Index rose 3.2 percent last month from a year earlier. A measure of inflation five to 10 years out has fluctuated this year in a range of 2.77 percent to 3.14 percent.

Five-year breakevens traded in a range of 2.08 percent to 2.91 percent from 2004 through July 2007, just before concerns over the value of housing debt sent banks? borrowing costs surging. The five-to-10-year index traded from 2.34 percent to 3.31 percent.

?Timely Manner?

A minority of Fed officials are concerned that the Fed?s record balance sheet risks igniting dangerous price increases. A failure to exit ?in a timely manner could have serious consequences for inflation and economic stability in the future,? Philadelphia?s Plosser said in a March speech.

?Should it prove necessary to counter inflationary pressures, I will be among the first to advocate the unwinding of some of the stimulus we have provided,? Fisher said May 4.

Any interest-rate increase may still be far off, as the threat of rising expectations receded this month, giving the Fed breathing room. ?You?ve got global uncertainties, some of which are abating, commodity prices moving off their peaks and oil prices drifting down, so I think that?s helpful,? Bullard said in an interview May 18.

?Transitory? Inflation

While the FOMC reiterated its view in the April 27 statement that the boost to inflation from higher commodity prices will be ?transitory,? Fed officials must be careful not to assume both food- and energy-price increases will dissipate and have little persistent effects on inflation, Davig said in an interview.

?Food prices have a tendency, when they go up, to be more persistent, and we do see that spillover from higher food prices into longer-term measures of inflation,? he said.

The attention the Fed pays to inflation expectations means investors, whether they agree with the central bank or not on the measures? importance, must pay attention themselves.

?The Fed absolutely does believe that inflation expectations matter,? said Steve Lear, who helps oversee $130 billion as deputy chief investment officer at J.P. Morgan Asset Management in New York. ?Needless to say, we care because the Fed cares.?

Why People Buy Bankrupt Stock

Ignoring the odds and hoping for leftovers after the debts are paid

Blockbuster's stock must be worth something, says Ron Krenn, a 48-year-old day trader in Daytona Beach, Fla., who hopes to profit on the equity of what was once the world's largest movie rental chain, seven months after it filed for Chapter 11. He's not alone. Since Sept. 23, the date of Blockbuster's bankruptcy, the stock price has ranged from 4 cents to 23 cents, with volume averaging 5.46 million shares a day.

Krenn and others who buy stock in bankrupt companies such as Lehman Brothers, Washington Mutual, and Borders hope there will be money left over for equity holders after all the debt is repaid. It's an increasingly risky gamble. Bankruptcies are less likely than ever to return anything back to stockholders, according to a new study.

Once a company files for Chapter 11, creditors are paid first in order of their seniority, with shareholders coming last after senior lenders, unsecured creditors, and holders of preferred stock. Unless creditors are paid in full, shareholders get nothing. If the company reorganizes, any stock in the new company usually goes to creditors.

Of 41 bankrupt public companies that announced reorganization plans in 2009 and 2010, only four delivered returns to shareholders, according to a study by Andrew Wood, a student at the UCLA School of Law who works with Lynn LoPucki, a UCLA bankruptcy law professor. Of the companies that went through bankruptcy from 1991 through 1996, 44 percent had returns for shareholders. The figure was 78 percent for those that went bankrupt from 1982 to 1987. "The number of cases in which equity makes more than a nominal recovery has steadily declined since approximately 1987," wrote Wood. The study cites an increase in the amount of secured debt carried by companies as one reason for the decline in shareholder recoveries. Wood also found a decline in recoveries for unsecured creditors.

Some speculators beat the odds. LoPucki cites the case of Tronox, a producer of titanium dioxide pigment, which gave shareholders 5 percent of the new stock when it reorganized. The shares trade near $130, up from $123 when the company emerged from bankruptcy on Feb. 15.

Stock investors don't get a final accounting until a bankrupt company files a disclosure statement, which details the terms of recovery for each class of creditor and announces whether existing shareholders get anything. Until then, the stock continues to trade as secured creditors and unsecured creditors fight over the company's worth and investigate potential lawsuits that could bring money into the bankrupt estate. Some investors bet on the stock, while those who sold it short?borrowing shares and selling them, hoping to buy them back later at a lower price?unwind their positions. Purchases by short sellers can sometimes lead to a temporary runup in price.

Blockbuster, which has yet to file a disclosure statement, said in a May 9 regulatory filing that it "anticipates" its A and B shares will be worth nothing. Krenn, who bought Blockbuster shares for 6 cents each in February, says he saw the company's regulatory filing, but dismissed it. "I still believe there is more to this shell," Krenn wrote in an e-mail on May 12, saying he was buying stock on the dips and awaiting news on the value of the company's Italian assets.

Some investors may trade on news about a bankrupt company without fully understanding it. Paul Rachmuth, a bankruptcy lawyer with Gersten Savage, represents Blockbuster shareholders. He says the sale of the company's assets to Dish Network (DISH) for $320 million on Apr. 7 effectively ended the chance that shareholders would get any money. Nonetheless, from Apr. 6 to Apr. 8, the stock rose 17 percent, to almost 7 cents a share. As of May 16, it was trading at just above 5 cents a share, giving the presumably worthless stock a market value of $9.7 million.

Jon Becker, 53, who owns a grocery store in Miami Beach, bought a few thousand dollars' worth of Blockbuster at 10 cents a share in February. He was still holding the shares when Dish Network bought the company's assets. Becker says he did not realize that the stock could end up worthless. He can't believe there was nothing on his screen to differentiate Blockbuster from other stocks he buys on E*Trade Financial (EFTC): "It's a different category than normal risk," he says. "If it's foreseeable shares would go to zero, I would think the powers that be would flash something?some kind of warning." Why did he buy a bankrupt stock in the first place? "My thought was, this is Blockbuster, it will come back," Becker says. It didn't. He finally sold at 7 cents a share.

The bottom line: Only 4 of 41 public companies that went through bankruptcy in 2009 and 2010 produced returns for shareholders.
